Terms of Service

These Terms of Service (“Terms”) apply to all apps, plugins and extensions developed by Fossil Apps (“we”, “us”, “our”), including Fossil: Fraud Country Blocker and Advizo: Astrology Chat & Call (each an “App”), on any platform where they are offered, such as Shopify, Wix, BigCommerce, WordPress or PrestaShop (each a “Platform”). By installing or using an App, you (“Merchant”, “you”) agree to these Terms. If you are using an App for a business, you confirm you are authorised to accept these Terms for that business. 1. The Apps

We grant you a limited, non-exclusive, non-transferable, revocable right to use the App with your store for as long as the App is installed and you comply with these Terms. We may add, change or remove features to improve the App, and we will notify you of material changes that reduce core functionality.

2. Platform terms

Your use of an App is also subject to the terms of the Platform you use (for example the Shopify Terms of Service and Shopify API License and Terms). If these Terms conflict with mandatory Platform rules, the Platform rules apply.

3. Plans, billing and free trials

  • Apps may offer free plans, free trials and paid plans. Current prices are shown on the App’s Platform listing and inside the App.
  • Charges are billed through the Platform’s billing system (for example Shopify billing) in the currency and cycle shown when you approve the charge. Taxes may apply.
  • You can upgrade, downgrade or cancel at any time from within the App or by uninstalling it.
  • We will give at least 30 days’ notice before increasing the price of an existing paid plan.

4. Refunds

Subscription fees are billed in advance and are generally non-refundable, including for partial billing periods. When you uninstall an App or cancel a plan, billing stops at the end of the current billing cycle according to the Platform’s billing rules. If you believe you were charged in error, contact us within 30 days of the charge at [email protected] and we will review it; approved refunds are issued through the Platform where possible.

5. Your responsibilities

  • Provide accurate information and keep your store and account secure.
  • Use the App in compliance with applicable laws, including consumer protection, privacy, payments and advertising laws in the regions where you sell.
  • Where you use an App to collect or process personal data of your customers, provide the notices and obtain any consents required by law, and include relevant information in your store’s privacy policy.
  • Do not use the App for unlawful, fraudulent, harmful or abusive purposes, or to provide services you are not legally permitted to provide.
  • Do not copy, modify, reverse engineer, resell or interfere with the App or its infrastructure.

6. App-specific terms

Fossil: Fraud Country Blocker

Location detection uses IP geolocation, which is not always accurate and can be bypassed with VPNs or proxies. The App helps reduce unwanted traffic but does not guarantee the prevention of fraud or chargebacks. You are responsible for the rules you configure and their effect on your store.

Advizo: Astrology Chat & Call

You and your consultants are solely responsible for the consultations, advice and services offered through the App, including any professional licences required. Astrology results are provided for entertainment and informational purposes and are not professional, medical, legal or financial advice. Consultation payments are processed through your store and belong to you; you are responsible for pricing, refunds to your customers and taxes on those sales.

7. Data and privacy

Our collection and use of personal information is described in each App’s privacy policy (Fraud Country Blocker, Advizo). For personal data of your customers and store visitors, you are the controller and we process it on your behalf, only to provide the App and according to your instructions given through the App’s settings. We respond to Platform privacy requests and delete store data after uninstall as described in the privacy policies.

8. Support and availability

We provide support by email as described on our Support page. We aim to keep the Apps available at all times, but they may be interrupted for maintenance, Platform changes or events beyond our control. We do not guarantee uninterrupted or error-free operation.

9. Intellectual property

The Apps, including their code, design and content, belong to Fossil Apps. You keep ownership of your store data and content. You grant us permission to use your data only to provide and improve the App. Feedback you give us may be used without obligation to you.

10. Disclaimer

Apps are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, Fossil Apps is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or business opportunities. Our total liability for any claim relating to an App is limited to the fees you paid for that App in the 12 months before the claim.

12. Indemnity

You agree to indemnify Fossil Apps against claims arising from your use of the App in breach of these Terms or applicable law, or from the services you or your consultants provide to your customers.

13. Suspension and termination

You may stop using an App at any time by uninstalling it. We may suspend or terminate access if you breach these Terms, if required by law or the Platform, or if we discontinue an App, in which case we will give reasonable notice where possible.

14. Changes to these Terms

We may update these Terms. Material changes will be posted on this page with a new “Last updated” date and, where appropriate, notified in the App or by email. Continued use after changes take effect means you accept them.

15. Governing law

These Terms are governed by the laws of India, and the courts at Kota, Rajasthan have exclusive jurisdiction, except where mandatory local law gives you the right to bring proceedings elsewhere.
